Terms of Service

1. Acceptance of Terms

By accessing or using Circa (“the App”), operated by Circa Events (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use the App.

2. Description of Service

Circa is a social event platform that allows users to discover, create, and manage events. Features include event creation, RSVP management, interactive widgets, real-time chat, location sharing, and social networking between event attendees.

3. User Accounts

To use certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of content you upload to the App, including photos, event descriptions, comments, and other materials (“User Content”). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely in connection with operating and improving the App. You represent that you have all necessary rights to upload such content and that it does not violate any third-party rights.

5. Prohibited Conduct and Objectionable Content

Circa has zero tolerance for objectionable content or abusive behaviour. You agree not to post, upload, transmit, or otherwise make available any content, and not to engage in any conduct, that:

• Is unlawful, fraudulent, or violates any applicable laws
• Harasses, threatens, bullies, stalks, or abuses another person
• Promotes hate, discrimination, or violence against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Is defamatory, obscene, pornographic, sexually explicit, or graphically violent
• Sexualizes minors or endangers children in any way
• Impersonates any person, organization, or entity, or misrepresents your affiliation
• Infringes the intellectual property, privacy, or other rights of any third party
• Contains spam, scams, phishing attempts, or unsolicited commercial solicitation
• Attempts to gain unauthorized access to the App, other accounts, or any of our systems
• Uses automated means to scrape, harvest, or collect data from the App
• Interferes with or disrupts the App, its infrastructure, or the experience of other users

We reserve the right to remove any content and to suspend or terminate any account that violates these Terms, with or without notice.

6. Reporting, Blocking, and Content Moderation

We provide tools so you can keep your Circa experience safe:

• Report: any event or user profile can be reported from inside the App by tapping the menu and selecting “Report”. You can choose a reason (spam, harassment, hate, sexual content, violence, impersonation, or other) and add details.
• Block: you can block any user from their profile or from Settings > Blocked Users. Blocked users cannot see your content and you will not see theirs anywhere in the App.
• Action timeline: we review every report and take action within 24 hours. Action may include warning the reported user, removing content, restricting features, or permanently suspending the account.
• Contact: you can also email info@circaevents.ca to report a safety issue or appeal a moderation decision.

By using Circa, you agree that we may use the reports you submit and the block lists you create to enforce these Terms and to protect the Circa community.

7. Event Hosting

If you create an event through the App, you are solely responsible for that event, including its content, management, and any obligations to attendees. We do not endorse, verify, or guarantee any event listed on the App. We are not liable for any disputes between event organizers and attendees.

8. Location Services

The App offers optional location-sharing features. By enabling these features, you consent to the collection and sharing of your location data with other users as described in our Privacy Policy. You can disable location sharing at any time through the App settings.

9. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Circa Events and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately and any data associated with your account may be permanently deleted.

11. Disclaimers

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Circa Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date at the top of this page. Your continued use of the App after changes constitutes acceptance of the revised Terms.
